Welcome to Quately. These Terms of Service ("Terms") govern your access to and use of our website, platform, and services ("Service"). By accessing or using Quately, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Overview of the Service

Quately is a Platform-as-a-Service (PaaS) that enables users to build and launch their own branded AI-powered SaaS businesses. We provide the infrastructure, tools, integrations, and management needed to operate your platform - you bring the brand and vision.

2. Eligibility

To use Quately, you must be
  • At least 18 years old
  • Legally capable of entering into a binding agreement
  • Using the platform for lawful business purposes
By registering, you confirm that you meet these requirements.

3. Account Registration

You are required to create an account to access most features of the platform. You agree to:
  • Provide accurate, current, and complete information
  • Keep your login credentials secure
  • Be responsible for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of the Platform

You agree to use Quately only for lawful purposes and in accordance with these Terms. You shall not:
  • Use the Service to transmit illegal or harmful content
  • Violate the rights of others, including intellectual property or privacy rights
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to the system or user data
We reserve the right to monitor platform usage and remove content or accounts that violate our policies.

5. Payment and Subscription Terms

Quately operates on a subscription model. You are responsible for:
  • Selecting the appropriate plan
  • Paying applicable subscription fees
  • Ensuring valid and up-to-date billing information
Your paid subscription will begin only after the 7-day free trial ends. Subscriptions renew automatically unless canceled before the end of the billing period.

6. No Refund Policy

We provide a 7-day free trial to help you evaluate the platform risk-free.
Because you have full access to test the product before purchasing, we do not offer refunds once a subscription has been activated.
If you are unsure, we recommend using the trial fully before upgrading. Our support team is available to assist you during this period.

7. Intellectual Property

All content, branding, code, and materials made available by Quately are the property of Quately or its licensors and are protected by intellectual property laws.
However, all content you create, including your business name, platform branding, and customer data, remains your own. Quately does not claim ownership over your business materials.
You are granted a limited, non-exclusive license to use the platform in accordance with these Terms.

8. Third-Party Integrations

Quately offers integrations with third-party services (e.g., AI providers, payment gateways, email tools). We are not responsible for the availability, performance, or terms of service of these third-party tools.
By using these integrations, you also agree to their respective terms and privacy policies.

9. Data Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to the processing of your data as described therein.
You retain ownership of all customer and business data. We do not sell or share your data without consent.

10. Termination

You may cancel your account at any time through your dashboard. Upon cancellation:
  • Your platform will be taken offline
  • Your access will be revoked at the end of your billing cycle
  • You may request a copy of your data before closure
We may suspend or terminate your access immediately if you breach these Terms or engage in misuse of the platform.

11. Modifications to the Service

We reserve the right to update or modify the Service at any time, including features, pricing, or usage limits. If a change significantly affects your use of the platform, we will provide reasonable notice.

12. Disclaimer of Warranties

Quately is provided “as is” and “as available.” We make no warranties, express or implied, regarding the operation, reliability, or availability of the platform.
We do not guarantee that the Service will be uninterrupted, error-free, or suitable for your specific needs.

13. Limitation of Liability

To the fullest extent permitted by law, Quately shall not be liable for any indirect, incidental, special, or consequential damages, including loss of revenue, profits, or data.
In no event will our total liability exceed the amount paid by you in the last 12 months of service.

14. Governing Law
